Correcting my own answer above, from our 5 September 2026 check. The 5 to 10 business days I quoted is not a state figure and I should not have used it. The Secretary of State publishes no standard turnaround for business filings, on the fee schedule, the LLC page or the expedite page, so any day count you read for West Virginia is somebody guessing. The rush tiers are real and unchanged, $25 for 24 hours, $250 for two hours, $500 for one hour, all on top of the filing fee. If you need a date you can rely on, that $25 is what buys it.

so i filed my articles with the wv secretary of state and got approved but then someone told me im not actually allowed to start selling yet because of some tax registration thing, is that real or were they confusing me

They were right. In West Virginia the Secretary of State approval forms your LLC, but you also need a $30 Business Registration Certificate from the State Tax Department before you legally conduct business. Your LLC is not fully operational on the SoS approval alone. The good news is you can file both through the WV One Stop Business Portal at the same time, so it is one visit, not two separate errands. Get that certificate squared away before you take your first sale.

West Virginia charges $101 to file your Articles of Organization online through the Secretary of State. The part people miss is a separate $30 Business Registration Certificate from the State Tax Department, which you legally need before doing business. That brings your minimum government cost to $131. You can handle both at once through the WV One Stop Business Portal. Add a registered agent fee if you are not serving as your own, and remember the $25 annual report each June. So plan on about $131 up front, not just the $101 headline number.
